1. Acceptance of Terms

By downloading, installing, or using the FreshDate mobile application (“App”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the App.

FreshDate Ltd (“we”, “us”, “our”) reserves the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes by email or in-app prompt.

Governing law: These Terms are governed by the laws of England and Wales.

Data practices: Your use of the App is also governed by our Privacy Policy, available at freshdate.co.uk/privacy.

2. Description of Service

FreshDate is a mobile application that helps users track food expiry dates, generate meal plans, and manage family dietary profiles. The App uses artificial intelligence to extract expiry dates from food labels and to suggest recipes based on available ingredients. Available on iOS and Android.

Key features:

AI-powered expiry date scanning from food packaging (via Manus LLM)

Food inventory tracking and management

Meal planning and recipe suggestions (powered by TheMealDB)

Multi-user household profiles

Push notifications for expiring items

Dietary preference and family profile management

3. Health & Illness Disclaimer

3.1 No Liability for Health Outcomes

We are NOT responsible for any illness, food poisoning, allergic reactions, or adverse health events resulting from your use of the App or reliance on any information provided, including:

Consumption of food items tracked in the App

Reliance on AI-generated expiry dates or food safety information

Nutritional information or meal suggestions provided by the App

Failure to verify expiry dates, ingredients, or allergen information on the packaging

3.2 Medical Conditions

If you have diabetes, allergies, pregnancy-related dietary restrictions, or any other medical condition affecting diet or nutrition, consult a qualified healthcare professional before making food decisions based on this App.

3.3 Allergen Information

The App may display allergen information sourced from third-party recipe and nutritional databases. This information may be incomplete or inaccurate. Always:

Read the full ingredient list on the product packaging

Check for allergen warnings and “may contain” statements on the label

Verify allergen information directly with the manufacturer if in doubt

Never rely solely on the App for allergen information

If you have a severe food allergy, do not use the App as your primary or sole source of allergen information.

3.4 Individual Responsibility

Your use of this App is at your own risk. You assume full responsibility for decisions made based on information provided by the App. Follow UK Food Standards Agency (FSA) guidelines for safe food handling and storage.

4. Food Safety & AI Limitations

4.1 AI Extraction Limitations

The App uses Manus LLM to extract expiry dates from food packaging photos. AI extraction has known limitations:

May misread faint, stamped, embossed, or dot-matrix printed dates

May confuse batch codes, production dates, or other markings with expiry dates

May fail on non-English packaging or unusual date formats

Accuracy not guaranteed under all lighting or packaging conditions

You must always verify expiry dates by reading the packaging directly. The App is a convenience tool, not a replacement for personal verification.

4.2 Date Labelling Standards

Different countries and food types use different standards (Best Before, Use By, Sell By, etc.). The App attempts to categorise these, but you are responsible for understanding the meaning of each date type on your specific products.

4.3 Storage Conditions

The App does not account for improper storage, temperature abuse, or contamination. Even if an expiry date has not passed, food may be unsafe. Always use your senses — if food looks or smells unusual, discard it immediately.

5. Subscription & Payments

5.1 Tiers

Free Tier: Limited to 10 food items and 2 household members.

Premium Tier: Unlimited items and members. Billed monthly (£4.99/month) or annually (£39.99/year).

5.2 Billing & Auto-Renewal

Subscriptions are managed by RevenueCat and billed through Apple App Store or Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.

5.3 Cancellation

You may cancel at any time through your device’s App Store or Google Play settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months or unused periods.

5.4 Refunds

Refund requests are handled by Apple or Google in accordance with their respective policies. We do not process refunds directly. Contact Apple or Google Support for refund enquiries.

5.5 Price Changes

Prices may change with 30 days’ notice. You may cancel before any new price takes effect.

6. Household Sharing & Family Profiles

6.1 Shared Access

The App allows you to create household profiles and invite family members to share a household. Each member with access can:

View and manage shared food inventory

Add, edit, or delete food items

Receive expiry notifications

6.2 Responsibility

Each user is responsible for their own food safety decisions. We are not responsible for disputes, miscommunication, or food safety issues arising from shared household use. You agree to use the App responsibly and not to add false or misleading information. You are responsible for supervising children’s use of the App.

7. Camera & Photo Data

When you use the camera scanner:

Photos are temporarily uploaded to secure Amazon S3 storage (food-labels/ bucket)

Photos are processed by Manus LLM for expiry date extraction

Photos are deleted from our servers immediately after processing (within seconds)

Photos are NOT permanently stored or used for any other purpose

OCR-extracted text (dates, product names) is retained as part of your food inventory

You must grant camera permission in your device settings to use this feature. You can revoke camera access at any time, which will disable the scanner. Full details of how photo data is handled are in our Privacy Policy at freshdate.co.uk/privacy.

8. Third-Party Services & Integrations

The App integrates with the following third-party services. Your use is subject to their terms and privacy policies. We are not responsible for the availability, accuracy, or practices of these services.

Supabase: Authentication and session management.

MySQL: Primary database for app data (food inventory, household data, meal plans).

Amazon Web Services (S3): Temporary photo storage during AI processing.

Manus LLM (forge.manus.im): AI-powered OCR for expiry date extraction.

RevenueCat: Subscription management and entitlements.

Apple App Store / Google Play: App distribution and payment processing.

TheMealDB: Recipe and meal planning data.

Expo / Firebase: Push notification delivery.

9. Push Notifications

The App sends push notifications to remind you of expiring food items. You can customise notification timing in Settings or disable notifications entirely through your device settings. We are not responsible for missed notifications due to device settings, network issues, or service outages.

10. User-Generated Content

You may add notes, meal plans, and custom food items to the App. You grant us a limited, non-exclusive licence to store and display this content within your household. You retain ownership of all content you create and can delete it at any time. We are not responsible for loss of content due to technical failures, account deletion, or service discontinuation.

11. Intellectual Property

The App, including all code, design, graphics, and content, is owned by FreshDate Ltd or licensed from third parties. You may not reproduce, modify, distribute, or reverse-engineer any part of the App without written permission. Recipe data from TheMealDB is subject to their licensing terms.

12. Account Termination

We reserve the right to suspend or terminate your account if you:

Violate these Terms & Conditions

Engage in abusive or fraudulent behaviour

Attempt to hack or compromise the App or other users’ accounts

Violate applicable laws

Upon termination, your data will be deleted within 30 days. You will lose access to any premium features.

13. Data Retention & Deletion

Active accounts: Your data is retained as long as your account is active.

Deleted accounts: All personal data (account info, food inventory, household data) is permanently deleted within 30 days. Backups may retain data for up to 90 days for disaster recovery.

Photos: Temporary photos used for scanning are deleted immediately after processing (within seconds).

14. Limitation of Liability

No liability for illness or injury: We are not liable for illness, food poisoning, allergic reactions, injury, or death resulting from your use of the App or reliance on any information provided.

Limited damages: Our total liability is limited to the amount you have paid in the past 12 months (£0 if you use the free tier).

No indirect damages: We are not liable for lost profits, lost data, business interruption, or any indirect or consequential damages.

No accuracy guarantee: The App is provided “as-is”. We do not guarantee accuracy of expiry dates, nutritional data, or recipes.

No liability for third-party services: We are not responsible for the availability or accuracy of Supabase, RevenueCat, TheMealDB, or any other third-party service.

15. Indemnification

You agree to indemnify and hold harmless FreshDate Ltd, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the App

Your violation of these Terms

Your violation of any applicable law

Food safety incidents or health issues resulting from your use of the App

16. Disclaimers

No medical advice: The App does not provide medical, nutritional, or dietary advice. Consult a healthcare professional for medical concerns.

No food safety guarantee: The App does not guarantee food safety. Follow UK Food Standards Agency (FSA) guidelines for safe food handling and storage.

AI limitations: Expiry date extraction is performed by AI and may be inaccurate. Always verify dates by reading the packaging directly.

Third-party data: Recipe and nutritional data from TheMealDB may be incomplete or inaccurate. Verify information from reliable sources.

Service availability: The App is provided “as-is.” We do not guarantee uninterrupted service or that the App will be free from errors or bugs.

18. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
