By downloading, installing, or using the FreshDate mobile application ("App") or website at freshdate.co.uk ("Website"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App or Website.
These Terms constitute a legally binding agreement between you and FreshDate Ltd, a company registered in England and Wales.
FreshDate is a food expiry tracking and household management application that provides:
You must be at least 13 years of age to use the App. By using the App, you represent that you are at least 13 years old. Users between 13 and 18 must have parental or guardian consent.

You may use the App without an account — food data will be stored locally on your device only.
The App is free to download and use with the following limitations: up to 10 food items, 2 household profiles, and no access to the meal planner.
Premium subscriptions unlock unlimited items, unlimited profiles, AI meal planning, and all future premium features. Subscriptions are available as:
Subscriptions are processed and managed through Apple App Store or Google Play. Payment is charged to your App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store or Google Play account settings. We do not issue refunds for partial subscription periods, except where required by applicable law.
We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price increase. Continued use of the subscription after the price change takes effect constitutes acceptance of the new price.
Important: FreshDate provides food expiry tracking as a convenience tool only. The App is not a substitute for your own judgement regarding food safety. Always use your senses — sight, smell, and taste — to assess whether food is safe to eat. Expiry dates are guidelines, not guarantees. FreshDate Ltd accepts no liability for illness, injury, or loss arising from reliance on dates displayed in the App.

The App, including its design, code, content, and branding, is owned by FreshDate Ltd and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
The FreshDate name, logo, and tagline "Know what's fresh. Waste nothing." are trademarks of FreshDate Ltd.
You retain ownership of all data you enter into the App (food items, meal plans, family profiles). By using the App, you grant FreshDate Ltd a limited licence to process this data solely for the purpose of providing the service to you. We do not use your food data for advertising, profiling, or sale to third parties.
To the maximum extent permitted by applicable law, FreshDate Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or any food safety incidents.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim, or £10, whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
You agree to indemnify and hold harmless FreshDate Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time within the App under Settings → Account → Delete Account.
We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 14 days before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
